2. THESE TERMS
These terms apply to purchases made through charmojo.uk. Please read them before placing an order. Nothing in these terms affects rights that consumers have under UK law.
3. PRODUCTS
We take reasonable care to describe and display products accurately. Colours and appearance may vary slightly because of screen settings, lighting and natural variations in materials. Product measurements are approximate unless stated otherwise.
4. ORDERING AND CONTRACT FORMATION
Submitting an order is an offer to buy. After you order, we will send an acknowledgement. A binding contract is formed when we send confirmation that the order has been accepted or dispatched. We may decline or cancel an order before acceptance, including where an item is unavailable, pricing is clearly incorrect, payment cannot be authorised, delivery restrictions apply or we reasonably suspect fraud. If payment has been taken for an order we cannot accept, it will be refunded.
5. PRICES AND PAYMENT
Prices are shown in pounds sterling unless stated otherwise. Applicable taxes and delivery charges are displayed before the order is submitted. Payment must be made using a method offered at checkout. We may correct obvious pricing errors before accepting an order.
6. PERSONALISED ITEMS
You are responsible for checking names, wording, sizes and other personalisation details before ordering. Personalised or made-to-specification products may not carry the statutory change-of-mind cancellation right. This does not affect rights where goods are faulty, damaged, misdescribed or incorrect.
7. DELIVERY
Delivery options, charges and current estimates are shown at checkout. Unless a different date is agreed, goods will be delivered without undue delay and no later than 30 days after the contract is made. Risk passes to you when the goods come into your physical possession or that of a person identified by you.
8. CANCELLATION, RETURNS AND REFUNDS
Your rights and the return procedure are explained in our Returns and Refunds Policy. For most non-exempt online purchases, UK consumers may cancel within 14 days after the day the goods are received. Personalised goods and certain hygiene-sealed goods may be exempt where the law permits.
9. FAULTY GOODS
Goods must be as described, of satisfactory quality and fit for purpose. If they are not, you may have remedies under the Consumer Rights Act 2015. Contact info@charmojo.com with your order number and details of the issue.
10. PROMOTIONS
Discount codes and promotions are subject to their stated conditions, availability and expiry date. Unless expressly allowed, promotions cannot be combined or applied retrospectively.
11. INTELLECTUAL PROPERTY
The website content, branding, photographs, designs and text are owned by or licensed to us and may not be copied, reproduced or commercially used without permission, except where law permits.
12. ACCEPTABLE USE
You must not misuse the website, introduce malicious code, attempt unauthorised access, interfere with operation, use the website unlawfully or infringe another person's rights.
13. LIABILITY
We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of statutory consumer rights. We are not responsible for losses that were not reasonably foreseeable when the contract was made. We supply products for private use and are not liable for business losses arising from consumer purchases.
14. PERSONAL INFORMATION
We process personal information as described in our Privacy Policy and use cookies and similar technologies as described in our Cookie Policy and consent controls.
15. EVENTS OUTSIDE OUR CONTROL
We are not responsible for delay or failure caused by events outside our reasonable control. We will contact you where appropriate and take reasonable steps to minimise the effect. Your statutory rights relating to late delivery remain unaffected.
16. CHANGES
The terms applying to an order are those in force when the order is placed. We may update these terms for future orders when our services, business practices or legal requirements change.
17. GOVERNING LAW
These terms are governed by the laws of England and Wales. Consumers may bring proceedings in the courts of the part of the United Kingdom in which they live where applicable.
